When we talk about “severance pay” in Ontario, there are actually two key legal frameworks to consider:

Statutory Severance Pay (under the Employment Standards Act, or ESA)

Common Law Severance (based on judge-made case law)

Each of these is calculated differently, and your total entitlement can vary widely depending on which applies to your situation.

1️⃣ Statutory Severance Pay – The Legal Minimum
Under Ontario’s Employment Standards Act (ESA), you may be entitled to:

Termination pay: One week of regular wages per year of service, up to a maximum of 8 weeks

Severance pay: One week per year of service (up to 26 weeks), if:

You worked for 5 or more years and

Your employer has a payroll of at least $2.5 million or 50+ employees were terminated in a 6-month period due to the same reason (e.g., mass layoff)

This is the minimum your employer must provide by law. However, the vast majority of employees are entitled to far more under common law.

2️⃣ Common Law Severance – What You’re Likely Owed
Most non-unionized employees in Ontario are entitled to common law reasonable notice or pay in lieu. This is not capped by legislation and is usually much higher than ESA minimums.

Courts look at four key factors when calculating common law severance:

Length of service: Longer service = more severance

Age: Older employees may receive more, due to potential difficulty in finding comparable work

Position and responsibilities: Senior roles or those requiring specialized skills often get more

Availability of similar employment: If it will take longer to find a similar job, severance is increased

Depending on these factors, courts may award between 3 to 6 weeks of pay per year of service, and in some cases even more. It’s not uncommon for employees to receive 6 months, 12 months, or even 24 months of severance depending on their circumstances.

Some employers try to limit severance to ESA minimums through termination clauses in your contract. However, many of these clauses are poorly drafted or unenforceable under Ontario law.
